1. Acceptance of Terms

By accessing or using WineIQ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App.

2. Description of Service

WineIQ is a personal AI sommelier application that allows users to:

  • Scan wine labels to identify and catalog wines
  • Manage a digital wine cellar
  • Receive AI-powered wine recommendations and food pairing suggestions
  • Access detailed information about wines including tasting notes and optimal drinking windows

3. User Responsibilities

You agree to:

  • Use the App in compliance with all applicable laws and regulations
  • Not use the App for any unlawful or prohibited purpose
  • Not attempt to gain unauthorized access to any part of the App or its related systems
  • Not interfere with or disrupt the App or servers connected to the App

4. Age Restrictions

WineIQ is intended for users of legal drinking age in their jurisdiction. By using the App, you confirm that you are of legal age to purchase and consume alcoholic beverages in your location. The App is designed to help users manage and enjoy wine responsibly. We do not promote excessive consumption of alcohol.

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of ContextIQ and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content obtained through the App without our express written permission.

6. AI-Generated Content and Recommendations

WineIQ uses artificial intelligence to provide wine information, recommendations, and pairing suggestions. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. All recommendations are suggestions only and should not be considered professional advice.

You acknowledge that wine preferences are subjective and that recommendations may not align with your personal taste. We encourage users to make their own informed decisions about wine selection and consumption.

7. User Content

Any content you create, upload, or store in the App, including wine cellar data, tasting notes, and photos, remains your property. By using the App, you grant us a limited license to use this content solely for the purpose of providing and improving the App's services.

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

8. Third-Party Services and Links

The App may contain links to third-party websites or services, including wine retailers or information sources. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk.

9. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the App.

IN NO EVENT SHALL CONTEXTIQ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party on the App
  • Unauthorized access, use, or alteration of your content

10. Indemnification

You agree to indemnify, defend, and hold harmless ContextIQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
